Program Summary

The trustee playbook for paying food and shelter expired on September 30, 2024

A three-rule SSI overhaul took effect on September 30, 2024, rewriting how in-kind support and maintenance (ISM) treats food and shelter disbursements from special needs trusts. A national PMV standard now governs rental subsidies. And in 2026, ABLE eligibility expands to beneficiaries who never qualified before.

The old habits now carry a price. Pay rent the familiar way, and the beneficiary's check shrinks. Some housing related expenses still reduce SSI; others no longer do. Fund an ABLE account without watching the $100,000 rule, and benefits are on the line. Ignore Medicaid payback, and the trade-offs compound. Open questions still await Treasury guidance.

Attendees walk out able to advise trustees on structuring disbursements under the new ISM framework, apply PMV rental subsidy strategies, review existing plans, identify beneficiaries who now qualify for ABLE accounts, and design coordinated trust-ABLE strategies that preserve SSI and Medicaid — practitioner judgment no template supplies.

Key topics to be discussed:

  • The Three-Rule Overhaul
What changed on September 30, 2024, and how the new ISM framework treats food and shelter disbursements.
  • PMV Rental Subsidy Strategies
How the national PMV standard reshapes rent payment strategies, and which housing related expenses still reduce SSI.
  • Trustee Decision Making
How the overhaul reshapes trustee disbursement decisions, and the open questions still awaiting Treasury guidance.
  • ABLE Eligibility & Funding
Who qualifies under the 2026 expansion, what documentation is required, and contribution mechanics from annual limits to multi source funding.
  • Preventing Shelter Reductions
Using ABLE accounts to manage shelter and other sensitive expenses without triggering SSI reductions — and where the $100,000 rule bites.
  • Coordinating Trusts And ABLE
Medicaid payback considerations, when robust ABLE funding is appropriate, and updating older SNT's.
