The Settlement Number Isn’t What Your Client Keeps
Plaintiffs in employment and discrimination cases often face tax exposure on their settlements. Yet, there are effective ways to reduce or defer those taxes. Strategic settlement language can exclude certain amounts from taxation. Structured settlements are also a powerful tool for spreading out and reducing tax burdens. This session will walk through each of these strategies and the steps needed for implementation.
A favorable settlement is only half the result, and what your client keeps is shaped by choices made before the agreement is signed. Leave the settlement language generic, and amounts that could be excluded from taxation may not be. Assume legal fees will be deductible, and your client may be left without relief. Take the full recovery up front, and the tax burden arrives all at once. Stay silent with defense counsel, and tax-efficient terms never reach the agreement.
Led by Jeremy Babener and co-presenter Kent Hansen, the session leaves you with settlement language that supports tax outcomes and an approach for raising sensitive tax issues with defense counsel. You also get a working view of arrangements that spread out tax burdens.
